Welcome to KinoSpring. These Terms of Service (“ToS”) govern your use of our Move On Demand services, including motion capture, video production, coaching, consulting, and any associated services. By booking or using our services, you agree to comply with these terms. Failure to comply may result in service termination, suspension, or legal action.

2. Scope of Services

KinoSpring provides the following services:

• Real-time motion capture sessions.
• Custom animation tailored to client needs.
• Full-service video production, including pre-production and post-production.
• Coaching and consulting for acting, scriptwriting, and visual storytelling.
• Branding and design, including logo and visual identity development.

3. Acceptable Use Policy

We are committed to maintaining a safe, respectful, and lawful environment. Clients must adhere to the following acceptable use guidelines:

Prohibited Content & Requests

You may not request or use our services for:

• Illegal Activities: Commands that promote illegal actions, including fraud, terrorism, or financial crime.
• Offensive Content: Including but not limited to sexually explicit material, hate speech, defamation, or harassment.
• Privacy Violations: Any use that infringes upon others’ privacy, including unauthorized use of personal data or likeness.
• Intellectual Property Violations: Requests involving unauthorized use of copyrighted materials, trademarks, or other intellectual property.

4. Content Restrictions

KinoSpring strictly prohibits requests involving:

• Graphic violence, nudity, or inappropriate sexual content.
• Defamatory, slanderous, or libelous movements.
• Content that violates local, national, or international laws.

5. Usage Limitations

You must not use our services for:

• Fraudulent Activities: Including deceptive practices or financial crimes.
• Terrorist Activities: Any direct or indirect involvement in acts of terrorism or violence.
• Illegal Financial Transactions: Including money laundering or illicit financial dealings.

KinoSpring reserves the right to terminate any session or refuse service if these terms are violated.

6. Client Responsibility & Legal Disclaimers

As a client, you are fully responsible for ensuring the legality and ethical nature of your requests.

Client Liability

By booking our services, you agree that:

• You will not request content or movements that violate local, national, or international laws.
• You are responsible for ensuring that any requests made during a session are legal and ethical.

Indemnification

You agree to indemnify and hold KinoSpring, its employees, and affiliates harmless from any claims, damages, losses, or legal fees arising from:

• Any misuse of the service.
• Violation of intellectual property rights or privacy laws.
• Any illegal actions or commands requested during a session.

If legal disputes arise due to your requests, you will bear the responsibility of resolving them and covering any associated costs.

7. Service Termination and Penalties

KinoSpring reserves the right to:

• Terminate Services: If violations of the ToS occur during a session.
• Suspend Services: Temporarily halt services for further investigation if suspicious activities are detected.
• Legal Action: Pursue legal action, including seeking damages or filing complaints if services are misused or illegal actions are requested.

8. Pre-Session Vetting Process

To ensure that all requests align with our ToS, KinoSpring has implemented the following vetting process:

Client Screening

Clients must complete a pre-session questionnaire covering:

• The goal of the project.
• The type of motion capture or content requested.
• Any sensitive or controversial content involved.

Project Overview Submission

Clients are required to submit a detailed project overview or script prior to booking, including:

• Characters, movements, and specific actions to be captured.
• The context of the project (e.g., film, game development, etc.).

KinoSpring reserves the right to refuse any project that violates our ToS or raises red flags during the vetting process.

9. Right to Refuse Service

KinoSpring reserves the right to refuse or terminate any service request that:

• Violates our ToS.
• Involves illegal, offensive, or inappropriate content.
• Could harm our reputation or is deemed ethically questionable.

10. Payment Terms

All payments must be made in full before the commencement of any session unless otherwise agreed in writing. KinoSpring accepts traditional payment methods as well as cryptoassets such as Bitcoin and USD stablecoin. Pricing is based on the complexity and scope of each project, and personalized quotes can be obtained through our contact page at kinospring.com.

11. Cancellation and Refund Policy

Cancellation Policy

• Cancellations: Clients may cancel their booking up to 48 hours before the scheduled session without any charges.
• Late Cancellations: If cancellations occur within the 48-hour window, partial fees may apply.

Refund Policy

• Unused Services: Full refunds will be issued for services not yet started within 30 days of purchase.
• In-Progress Services: For packages already in progress, refunds will be provided on a pro-rata basis.

12. Modification of Terms

KinoSpring reserves the right to modify these ToS at any time. Clients will be notified of any changes via email or through our website. Continued use of our services after such changes indicates your acceptance of the new terms.

13. Dispute Resolution

In the event of a dispute, both KinoSpring and the client agree to resolve conflicts through mediation or arbitration. Any legal disputes will be governed by the laws of France, where KinoSpring’s physical studio is based.
